E’ obbligatorio emettere fattura (o scontrino fiscale) per ogni vendita che passa attraverso un e-commerce?
La domanda fatidica è la seguente: E’ obbligatorio emettere fattura (o scontrino fiscale) per ogni vendita che passa attraverso un e-commerce?
La risposta alla domanda è “NO”, ovvero non è obbligatorio emettere fattura se il sito e-commerce è di tipo indiretto (che differisce dalla vendita di tipo diretta).
La normativa IVA prevede particolari semplificazioni per coloro che esercitano l’attività di E-commerce. Infatti, non vi è l’obbligo di certificare i corrispettivi (emissione fattura/scontrino o ricevuta fiscale) quando le vendite o le prestazioni di servizi sono effettuate nei confronti di consumatori finali (B2C) residenti nel territorio dello Stato. È sufficiente la sola indicazione nel registro dei corrispettivi.
Attenzione però, la normativa IVA cambia a seconda che trattasi di E-commerce diretto o E-commerce indiretto.
Per vendita elettronica indiretta (o comunemente e-commerce indiretto) si intende una transazione telematica che avviene tramite l’e-commerce alla quale segue una spedizione di merce fisica (beni o materiali fisici); quindi “indiretta” appunto perchè all’acquisto segue una spedizione tramite corriere.
Una transazione diretta invece può essere l’acquisto di un servizio, un software, o dei contenuti scaricabili.
COME CERTIFICARE I CORRISPETTIVI NELL’ E-COMMERCE?
Nell’E-commerce sia diretto che indiretto non è necessario certificare i corrispettivi verso i soggetti privati e la normativa applicabile è quella relativa alle vendite per corrispondenza.
L’Agenzia delle Entrate ha infatti chiarito, con la risoluzione 274/E/2009, che è necessario emettere fattura solo quando il cliente ne faccia richiesta al momento dell’operazione e che pertanto le cessioni sono esonerate dall’obbligo di emissione di ricevuta/scontrino fiscale o fattura.
Tuttavia, i corrispettivi giornalieri devono essere annotati entro il giorno successivo non festivo nel registro dei corrispettivi di vendita ed il venditore resta soggetto a tutti gli obblighi IVA quali liquidazioni periodiche, conservazione della documentazione, etc.
Nell’E-commerce diretto, pertanto, la certificazione dei corrispettivi è obbligatoria soltanto per le operazioni effettuate nei confronti di committenti titolari di partita IVA, sia residenti che non residenti. In questi casi è obbligatoria l’emissione della fattura datata e numerata in ordine progressivo.
